Please read these Terms of Service carefully before purchasing or using StackStats. By downloading, installing, or using the application, you agree to be bound by these terms. If you do not agree, do not use the software.
StackStats is a local desktop application for macOS and Windows that imports Substack CSV exports and generates analytics dashboards and AI-powered insights. The software runs entirely on your local machine. No data is transmitted to our servers except as described in Section 9 (License Validation). StackStats is developed and published by Rishikesh Technology, owned and operated by Rishikesh Sreehari, Abu Dhabi, UAE.
Subject to your purchase of a valid license and continued compliance with these Terms, Rishikesh Technology (“we”, “us”, “Company”) grants you a non-exclusive, non-transferable, non-sublicensable license to install and use StackStats on the number of personal devices permitted under your license tier (as specified below), provided those devices are owned or controlled by you.

Any breach of these restrictions will result in immediate termination of your license without refund. We reserve the right to pursue any and all legal remedies available under applicable law — including but not limited to claims under copyright law, breach of contract, and unjust enrichment — against any individual or entity found to be distributing, cracking, or pirating StackStats.
StackStats supports integration with third-party AI providers including Anthropic, OpenAI, Google Gemini, Groq, OpenRouter, Ollama, and compatible APIs. These integrations require you to supply your own API keys (“Bring Your Own Key” or BYOK). Your use of these third-party services is governed entirely by the terms and privacy policies of the respective providers. We have no control over, and accept no liability for, the actions or data practices of third-party AI providers.
StackStats relies on CSV export files generated by Substack. Substack is an independent third-party platform that may change its data export formats, file structures, or the availability of exports at any time without notice.
In the event that Substack modifies its export format in a way that affects the functionality of StackStats, we will use reasonable efforts to release a compatibility update within thirty (30) calendar days of becoming aware of the change, provided that:
We do not guarantee that we will be able to accommodate all platform changes. Where a Substack change makes it impossible or commercially unreasonable to maintain compatibility — including but not limited to Substack removing data exports entirely, requiring account authentication that prevents local export, or introducing technical restrictions that cannot be circumvented — we shall have no liability to you for any resulting loss of functionality. In such circumstances, we will communicate the situation transparently.
If Substack introduces a public API in the future, we may, at our sole discretion, integrate such API functionality into StackStats or release a separate product that leverages it. Any such integration will be assessed based on technical complexity, API terms and conditions, and commercial viability. Nothing in these Terms creates any obligation on our part to integrate with a future Substack API. If we elect to build such functionality, we will communicate clearly whether it will be:

STACKSTATS IS PROVIDED “AS IS” AND “AS AVAILABLE” WITH NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RISHIKESH TECHNOLOGY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF BUGS, VIRUSES, OR OTHER HARMFUL COMPONENTS. YOUR USE OF STACKSTATS IS ENTIRELY AT YOUR OWN RISK.

You assume full responsibility for any decisions made based on data or insights produced by StackStats.
To the maximum extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, loss of data, or business interruption, arising from or related to your use of or inability to use StackStats, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under or in connection with these Terms or your use of StackStats shall not exceed the amount you paid for your license in the twelve (12) months preceding the claim.
To activate and validate your license, StackStats transmits your license key and a device fingerprint (a hardware-based identifier generated by your machine) to our license validation server. This process is described in detail in our Privacy Policy. No newsletter data, subscriber information, or analytics data is ever transmitted.
We want you to be satisfied with StackStats. If you are not satisfied for any reason, you may request a refund subject to the following conditions:

Technical support for StackStats is provided on a reasonable-efforts basis. To request support, email [email protected]. We aim to respond to support requests within three (3) business days, though response times may vary. Support is provided in English.
Support does not cover issues arising from third-party AI provider outages or API changes, unsupported operating system configurations, or modifications to the software made by the user.
We may release updates to StackStats at our discretion. Updates may add features, fix bugs, or change existing functionality. For Annual License holders, updates are included during the twelve-month coverage period. For Lifetime License holders, all updates are included indefinitely.
We reserve the right to discontinue StackStats at any time. In the event of discontinuation, we will provide reasonable notice. License holders retain the right to continue using the last released version of the software under their existing license terms.
StackStats, including its source code, design, trademarks, and all related intellectual property, is owned by Rishikesh Technology (Rishikesh Sreehari). Nothing in these Terms transfers any intellectual property rights to you. You are granted only the limited license described in Section 2.
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the use of StackStats shall be subject to the exclusive jurisdiction of the courts of the UAE. You consent to the personal jurisdiction of such courts and waive any objection to venue.
We reserve the right to update these Terms at any time. Where changes are material, we will notify you via email (if provided) or via notice in the application. Continued use of StackStats after the effective date of amended Terms constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us with respect to StackStats and supersede all prior agreements, representations, or understandings, whether oral or written.
